By viewing or utilizing our website in anyway you acknowledge that you are at least twenty one (21) years of age in the United States or of valid drinking age in the country you are currently located.
We only ship to residential and business physical address, P.O. boxes are not a valid shipping address.
Items presented on this site are only an offer to sell. The sale is not complete until an employee of Elma Wine & Liquor has reviewed, accepted and processed the order at which point you will receive a confirmation email. We reserve the right to ask for additional age verification such as a scanned or faxed image of a valid driver’s license or passport.
If you do not wish to place an order online you may place an order by phone however you still agree to all Terms & Conditions laid out on this page.
All wines are sold in New York and title passes to the buyer in New York when the order has been accepted by an employee of Elma Wine & Liquor. We make no representation to the legal rights of anyone to ship or import alcohol into any state outside New York. By placing your order you understand that Elma Wine & Liquor is providing a service and acting on behalf of the purchaser to arrange transportation for your wine and/or liquor. We do not apply for or obtain any permits for shipment on your behalf. We strongly encourage the buyer to check their state and local laws and regulations regarding the shipping and importing of alcohol as the buyer assumes complete responsibility for any shipment. By placing an order you acknowledge that you understand the shipping rules of your state and that you take responsibility for abiding by any limitations your state or local government have on quantities of alcohol purchased and/or shipped as well as any tax or duty related to the purchase.
Due to state regulations, at this time we can only ship to the following states: Alaska, California, Idaho, Louisiana, Nebraska, Nevada, New Hampshire, New Mexico, New York, North Dakota, Oregon, Puerto Rico, Virginia, Washington D.C., West Virginia, and Wyoming.
If you place an order to a state not listed here, your order will be subject to a 15% restocking fee.
We accept Visa, MasterCard, Discover and American Express. All credit card data is transmitted securely.
All items shown on this website are believed to be in stock; however, because data from our in-store system is not connected in real time there may be instances where product quantities are not accurate. When quantity errors are discovered we work quickly with our wholesalers to re-stock our store and get your shipment out as quickly as possible. Our typical turnaround time is one to two business days, however we reserve the right to delay shipment up to seven days for inventory related issues. If shipment will occur more than 72 hours after your order was accepted we will notify you and give you an estimated shipping date. In instances of older vintages and other rare or limited releases, we will do our best to fill your order but cannot be held responsible if an item is unobtainable at that time. If we cannot fulfill your order for any reason you will receive a full refund.
Elma Wine & Liquor reserves the right to charge additional fees for extra packaging materials required to keep bottles safe during transit.
Elma Wine & Liquor reserves the right to limit quantities of any product at any time.
Corked or otherwise defective bottles must be returned within six months of purchase and contain at least 75% of the wine. Wine purchased more than six months prior may not be returned. Additionally, as is customary in the retail wine industry, any bottle in excess of 10 years old cannot be returned for any reason and the purchaser assumes all risk. We do make every effort to control the conditions in which older bottles are stored, but cannot make any guarantee.
A restocking or cancellation fee of 15% of the price of the wine will be applied to any refusal or return after we have packaged the order. Shipping charges will not be refunded for any refused or cancelled order that has already been picked up by the shipping company.
If you receive a broken or damaged product please photograph the breakage as you discovered it and notify us immediately.
All information on the site, both general content and product specific information, is thought to be accurate and up-to-date. There may, on occasion, be inaccuracies in the information provided for a variety or reasons including technical or typographical omissions or errors. We cannot be held responsible for any inaccuracies found on this site.
We reserve the right to update or revise the Terms & Conditions presented on this page through the updating or revising of said page. Any change to this page shall be constituted as an update to the Terms & Conditions and be in effect immediately. Users are advised to review this page on occasion for any changes or updates relevant to them.

Shipping Wine In Inclement Weather
We check local temperatures at our location and at the final destination point before shipping. If temperatures reach extreme highs or lows we will hold the shipment until the temperature falls in a satisfactory range. If you have any concerns about the weather and want your shipment held or shipped despite our warnings please contact us.
We store all wines in a climate controlled environment, but cannot make any guarantees after they leave our premises and therefore cannot be held responsible for any damage to the wine from any climate related issues.
All customers will be asked to verify their age before finalizing checkout. In addition, a signature is required on delivery of someone 21 years or older. No packages will be left at a residence or business without a valid signature of someone 21 years or older. We therefore recommend that you have your shipment sent to a business address unless you are certain that someone 21 years of age will be home to receive the package. We reserve the right to ask for additional age verification such as a scanned or faxed image of a valid driver’s license or passport before your order is processed.
FedEx will only make a finite number of attempts to deliver the package after which they will return the package to Elma Wine & Liquor. In such cases the delivery charges are non-refundable and a 15% restocking fee will apply.
Elma Wine & Liquor appreciates and encourages customers to leave honest feedback about the products they have purchased from our store. Please limit your comments to the specific product you are reviewing at the time and refrain from general comments, compliments, or critiques of our service or selection (we encourage and appreciate those through other online outlets such as Google and Facebook). We reserve the right to edit comments in a way that does not materially change the substance or message being conveyed or to remove and block any comments.
Customer reviews are made by fellow customers and Elma Wine & Liquor does not take any responsibility for inaccurate or false information about a product. Utilize these reviews at your own discretion.
Any staff comments or tasting notes provided by Elma Wine & Liquor or its staff represent only the opinions of employees and not those of the company. Our staff make every effort to make accurate representations of products, but occasionally other circumstances surrounding the situation in which they sampled a product could lead to altered perception or tastes. Returns of regularly stocked products are accepted within 14 days of receipt by purchaser. Original receipt must accompany any return. Returned products must be sealed and in good condition. If returning a product shipped, please contact us within 14 days with your order number and we will provide instructions for returning your items. Do Not ship items to us without contacting us first. All returns are subject to 15% restocking fee plus all related shipping fees.
